WA gets One Metre Safe Passing Law

Postby Aushiker » Tue Jul 28, 2015 10:58 am

or it seems so if the Road Safety Commission is to believed ... have I missed a rule change :wink:

Going by this page at the Commission's website dated 24/7/2015 3:42:08 PM ...

Cyclists amongst other things ...

Can’t ride less than 2m behind a vehicle; [must check but I thought there was a 50 metre allowance?]
Must give way to vehicles exiting a roundabout; [mmm only when turning right in the roundabout IIRC]
Should ensure visibility by wearing reflective or fluorescent clothing [new one on me ... anyone have the Regulations on this?]

Drivers amongst other things [kudos to Commission not referring to cars or motor vehicles here]

When overtaking cyclists, must do so at a distance of at least one metre; [Failing to overtake a bicycle at a safe distance = 4 demerit points and $400 fine if the WA Police actually prosecute such an offence]
Must give way to cyclists if crossing an on-road bicycle lane;

with references to the fluorescent clothing: does the use of the term 'should' indicate advice as opposed to law?

The title of this discussion had me looking at the calendar to ensure it wasn't April 1st.

LC Daily Notice Paper No. 135 - Wednesday, 17 June 2015 still has the bill for second reading. Haven't checked since. Nothing on bicyles on slp.wa.gov.au except fixing a typo in January and some stuff on parking, AFAICS

can use the left lane of a roundabout when turning right, provided they give way to all exiting traffic...

Def something wrong here unless the legislation has passed through parliment changing the current law.

I think this is a blopper, me thinks

Also "bicycle lane" is not an area on the edge of the road defined by a white line and a bicycle symbol.
It must be, a sign stating, "bicycle lane" or a bicycle symbol with "lane" written underneath. There are not many lanes in WA marked correctly.

Just one more note:
This is not the act or the regulations, it is summary for quick reference. Some requirements have been left out, like, pedals need a reflective device facing backwards and the wheels need to be fitted with reflectors able to be seen from both sides.

Just to clarify legal talk;

Shall = must

Should = recommended

Creating the false belief of a 1m ( to 1.5m ) safety buffer between cyclists and cars that only cyclists are likely to hear about will cause safety issues, as the cyclist may not be expecting cars to regularly come within this distance.

Bad information is significantly worse than no information at all.

Also, won't be long before their web site is hacked... I tried to use their response form, and all the database responses came up on my screen.... Very very bad programming. So instead I sent them an email asking them to correct the bad information. I'll respond back here with whatever they tell me in return.

From the site: "Published: 29/7/2015 2:20:16 PM" - Looks like they corrected the website very quickly ! I didn't hear back from them, but I am impressed with the speed they fixed it at -

That is a change in the page. My OP was based on what was published at the date and time I quoted.

This is correct - They changed the page within an hour of receiving my email - I never heard back from them, but they did respond very quickly to my complaint about the misinformation.

By the time I posted that I had requested the change, it was already complete.

David.

An Update,

Christabel Fernandez from the RSC came back to me and confirmed that they had corrected the information that Aushiker picked up - Some great customer service there from a government department - I hope that this marks the start of some good campaigns to keep us all safe :)
