Some more details from Channel 9 News. The driver's blood alcohol level was three times the legal limit. He fled the scene and was found 2km down the road. It was a white ute. He was also charged with dangerous operation of a motor vehicle due to an incident with another cyclist half an hour earlier. if this despicable human being doesn't go to gaol for at least five years it will be another example of injustice.

i was reading some FB posts and i realised that the cyclist involved was Steve Smalls. the designer/creator of the WURKSTAND.

What I hate is that they always add " the truck driver was unhurt" or not injured etc. Hell ,an 8 ton truck runs over a bike and we have to know the trucky is unharmed.

Hans Battaerd, 59, was riding north along the Pacific Highway on Wednesday morning when he was hit by a Mitsubishi Outlander near the Tamarind Drive overpass, police said.

Awful.

I hear, from someone who knows the victim and others in the bunch, the motorist was turning right off Mona Vale Rd, across the path of the descending bunch, which was strung out. Two riders passed ahead of the right turner, which has then proceeded... I suppose we will see what the coroner says.

My thoughts are with family and friends of this rider.

It would be nice if the dangerous driving charge is successfully made out.

However, I think it will be challenging to do so based on the links to the offense provisions provided by @find_bruce elsewhere, and I'm glad they've got the negligence charge in there as a backup. Hopefully the police have some evidence up their sleeve that has not been made public that will help.

Not the kind of entertainment I was looking forward to over the coming year or more.

On NYE, in Darwin another cyclist died in hit and run.

The ever-intensifying police search for two suspects in a fatal New Year’s Eve hit-and-run continued Tuesday.
Dozens of police searched Darwin’s suburbs for a blue 2010 Toyota Aurion which witnesses say struck and killed 46-year-old Jason McCormick.
Detective Acting Senior Sergeant Tony Henrys said the 34-year-old man was arrested near the Capricornia Hotel in Fannie Bay late Tuesday.
He has been charged with recklessly endangering serious harm; driving a vehicle in a dangerous manner; and driving a motor vehicle while disqualified.
The man was remanded to appear in the Darwin Local Court on Thursday.
The car, which was reportedly speeding along Winnellie Rd at the time of the crash, struck Mr McCormick after he had fallen off his bike.
Friends say he was riding a short distance home after a drinks at the Winnellie Hotel.

A cyclist has been killed in a collision between a truck and a group of riders on the outskirts of Port Pirie in South Australia's mid-north.

SA truck driver should face maximum penalty over fatal crash with cyclists, court told

A truck driver who was under the influence of drugs when he ploughed into a group of cyclists near Port Pirie in South Australia has apologised to the family of the man he killed.

Sean Anthony Daley, 49, of Two Wells killed cyclist Steve Eberhardt in the collision almost a year ago, and seriously injured two others.

During sentencing submissions, the court heard 13 victim impact statements from family and friends of the man killed and those injured

Ms Eberhardt asked the court for the maximum penalty, to send a "clear and concise" message to the trucking industry that the use of drugs to meet demanding delivery deadlines needed to stop.

Daley sat slumped in the dock during the victim impact statements, and was breathing deeply and at one point appeared to wipe tears.

He read part of a statement to the family, but said he was not able to read the whole thing.

"I am sincerely sorry for the pain and suffering I have caused," he said.

"Every day I think about the horrible images of that day ... that a man has passed away."

He said no words could do his sorrow justice, and he would live with the guilt of his actions for the rest of his life.

You drove with drugs in your system. You probably were distracted or affected at the time you hit those cyclists in broad daylight. Own it dude.

More playing the victim from the driver's lawyer - it's all the transport company's fault he was taking amphetamines & recording fake log book entries. Funnily enough his timesheets were accurate or he wouldn't get paid enough.

The reason transport companies can pull that sort of crap is because people like Sean Daley are willing to do so for their own reward. Yes the company deserves to be punished, but that doesn't reduce the drivers culpability.
