I think you'll find that you'd be protected by eBay if it was a fake due to the heading saying Petzl Actik.
You have to make up your own mind as you do for all auctions but if you find it ambiguous then that is what the facility to ask the seller questions is for.
Many have been sold and the seller appears to have no red faces in their feedback.

Or, this recent release is a pretty good looking weight weenie headlamp from Nitecore (I have one of their mini flashlights and it's excellent) at 1/3 the weight and a nice CRI reading LED, but half the mAH battery and a bit more cash.

in the region of 350 good feedback with no bad ones amongst it, it has to be said.

Well it certainly looks the goods. You're right in that Ebay will resolve any glaring issues. Half the weight of my current headtorch and probably better light.
